Joe Jonas Spotted with Brother Nick After He and Sophie Turner Agree to Temporarily Keep Kids in N.Y.C.

Joe and Sophie Turner temporarily agreed to keep their daughters in New York through an interim consent order filed on Monday

Joe Jonas was seen out with his brother Nick Jonas on Monday amid the latest development in his divorce from Sophie Turner and their custody disagreement.

The brothers stepped out together in New York City on the same day in which Joe, 34, and Turner, 27, temporarily agreed to keep their daughters in New York through an interim consent order. The document, which was filed in New York and obtained by PEOPLE, shows that the estranged couple's children must remain in the Southern and Eastern districts of New York, which includes New York City, the Hudson Valley, and Long Island.

The former couple are parents to 3-year-old Willa and a 14-month-old daughter identified in previous court filings as D.

If the agreement is violated, the documents state that the court has the right to "take or cause to be taken measures under Federal or State law, as appropriate, to protect the well-being of the child involved or to prevent the child's further removal or concealment before the final disposition of the petition."

Monday's development comes days after Turner filed a lawsuit against the boy band member requesting that their daughters be returned to England. In the lawsuit, Turner alleged that Jonas was withholding their passports and called for "the immediate return of children wrongfully removed or wrongfully retained."

A representative for Joe disputed Turner's claims in a statement obtained by PEOPLE.

“After multiple conversations with Sophie, Joe initiated divorce proceedings in Florida, as Florida is the appropriate jurisdiction for the case," the statement read in part. "Sophie was aware that Joe was going to file for divorce. The Florida Court has already entered an order that restricts both parents from relocating the children. Sophie was served with this order on September 6, 2023, more than two weeks ago."

The singer and the former Game of Thrones star were married for four years when Joe filed for divorce on Sept. 5. A source who knows the former couple told PEOPLE at the time that the divorce did not come as a "surprise" to those around them.

"As far as custody goes, this literally all just happened, so they're figuring it out in real time," the source said. "They did have a prenup. As a family, they were based in Florida. The kids were with him the last few months, traveling with him with family while he's been on tour. Sophie's been working in the UK."

Turner and Joe married in 2019. On Sept. 6, the day after Joe filed for divorce, the couple issued a statement on their respective Instagram pages confirming their plans to separate.

“Statement from the two of us: 'After four wonderful years of marriage we have mutually decided to amicably end our marriage,'” they shared on Instagram.

“There are many speculative narratives as to why, but truly this is a united decision and we sincerely hope that everyone can respect our wishes for privacy for us and our children,'" the statement concluded.
